Flowy Terms of Use

Welcome to Flowy! Flowy ("we," "us," or "our") provides an AI-powered Twitter content generation SaaS platform that helps users generate, schedule, and manage Twitter content using artificial intelligence (the "Services"). These Terms of Use ("Terms") govern your access to and use of the Flowy website, applications, and Services. Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By accessing or using any part of the Services, you agree to be bound by these Terms and all policies referenced herein. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms, in which case the terms "you" or "your" shall refer to such entity. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms and may not use the Services.

2. Eligibility and Registration

To access certain features of the Services, you must register for a Flowy account. When you register, you agree to provide accurate, current, and complete information, including your real name, email, and timezone. You agree to promptly update your account information with any new information. You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify Flowy immediately of any unauthorized use of your account. Your data, including email, name, and timezone, will be saved in our database until you request account deletion. Upon account deletion, all your data will be permanently removed from our database.

3. Subscription Model and Payment

Flowy offers various subscription tiers (Starter, Pro, Business) with different features, tweet post limits, AI points allocation, and AI analysis limits. By subscribing to a plan, you agree to pay the applicable fees. Payments are processed through Stripe. All fees are non-refundable, and there are no prorated refunds upon termination or cancellation. We reserve the right to adjust pricing at any time, with notice provided to you. Your subscription will automatically renew unless you cancel it prior to the end of your current billing period. You can manage your subscription within your Flowy account settings.

4. Proprietary Rights and User-Generated Content

4.1. Flowy Content

All content provided by Flowy, including text, graphics, logos, and software, excluding user-generated content, is the property of Flowy or its licensors and is protected by intellectual property laws. You may not reproduce, modify, distribute, or exploit any Flowy Content without our prior written consent.

4.2. User-Generated Content

You retain all rights in the content you generate, schedule, and manage using Flowy (your "User Content"). However, by using the Services, you grant Flowy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services, including for analytics and improvements. This license is solely for the purpose of operating and improving the Services. Ownership of your User Content remains with you.

4.3. AI-Generated Content Disclaimer

Flowy utilizes AI to generate tweets. While we strive for accuracy, AI-generated content may contain inaccuracies or unintended outputs. You are solely responsible for reviewing and approving all AI-generated content before posting it. Flowy is not liable for any damages or issues arising from user-shared or AI-generated content.

5. Prohibited Uses

You agree not to use the Services for any unlawful or prohibited activities, including but not limited to:

  • Engaging in hate speech, harassment, threats, or discrimination.
  • Promoting violence or illegal activities.
  • Posting adult content or spam.
  • Infringing upon the intellectual property rights of others, including plagiarism or copyright infringement. You bear full responsibility for any such issues related to your User Content.
  • Attempting to gain unauthorized access to our systems or other users' accounts.
  • Interfering with or disrupting the integrity or performance of the Services.

6. Third-Party Services

Flowy integrates with various third-party services to provide its functionalities:

  • Twitter API: Used for posting tweets on behalf of users.
  • OpenAI API: Used for AI-powered tweet generation.
  • Stripe: Used for processing subscription payments.

Your use of these third-party services is subject to their respective terms and privacy policies. Flowy is not responsible for the practices of these third parties.

7. Security Practices and Data Breach Notification

We implement security measures, such as password encryption and access controls, to protect your data. In the event of a data breach, we will notify affected users promptly, take immediate steps to resolve the issue, and inform you of our solutions and results.

8. Changes to Terms

Flowy reserves the right to modify these Terms at any time. We will notify you of any updates, and your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising from these Terms will be resolved in the courts located in Prague, Czech Republic.
